Before Continuing to Payment
Please review and confirm the key terms of your HomeShift agreement:
- One-time plan fee: $2,400–$5,000 per plan for marketing, advertising and coordination only. This fee covers our time and services and is non-refundable once any work begins (for example, consultation, file review, drafting your listing or contacting third parties).
- No guarantee of sale, exit or transfer: We cannot promise that your timeshare or property will sell, rent, transfer or be released. Results depend on market conditions, third parties and your cooperation.
- Success & referral fees: If your property sells or transfers via HomeShift or our partner network, a 10% success commission (based on the final sale/transfer price) is due at closing. If it sells or transfers by any other party or method during this agreement, a 5% referral fee is due at closing.
- Notify & instruct closing: You agree to notify HomeShift of any signed sale/transfer contract and instruct the closing, title, escrow or settlement company to remit any owed HomeShift fees directly from the closing proceeds.
- Payment processing & card authorisation: You understand that payments are processed through secure, PCI-compliant third-party payment processors (for example Checkout.com, Stripe or their banking partners), and by proceeding you authorise the one-time charge for the selected plan in accordance with the Terms & Conditions.

Key Clauses (short form)
- Nature of services. HomeShift (and any related brands) provides marketing, advertising, administrative and coordination services to help connect owners with potential buyers, renters, brokers and third-party service providers. We are not a law firm, financial adviser, tax adviser, credit repair company, escrow/closing agent or real estate broker, and we do not provide legal, tax, investment or credit advice.
- No guarantee of outcome. We cannot and do not guarantee a sale, rental, exit, transfer, cancellation, deed-back or any specific result. All outcomes depend on market conditions, resort or developer policies, third-party decisions and your cooperation.
- Setup & plan fees. A one-time marketing/coordination fee per property and per plan (as shown at checkout) is charged for our time, work and access to our platform. This fee becomes non-refundable once any work begins (including consultation, file review, listing preparation or outreach on your behalf), except where we are required by law to offer a cooling-off or refund period.
- Success & referral fees. If your property sells or transfers through HomeShift or our partner network, a 10% success commission based on the final sale/transfer price is due at closing. If your property sells or transfers by any other party or method during the agreement period, a 5% referral fee is due at closing. You authorise us to provide notice of these fees to any closing, title, escrow or settlement company involved.
- Agreement period & exclusivity. Unless otherwise stated in writing, this agreement starts on the date you pay the setup/plan fee and continues for the life of the listing or engagement, until you receive written confirmation from HomeShift that the agreement has been released or terminated.
- Owner responsibilities. You agree to: (i) provide complete and accurate information about your ownership, finances and contact details; (ii) promptly notify HomeShift of any sale, transfer or change of status; and (iii) instruct the closing, title, escrow or settlement company to pay any owed HomeShift fees directly from closing proceeds.
- Payment processing & card authorisation. Card payments are processed through secure, PCI-compliant third-party payment processors (for example Checkout.com, Stripe or their banking/billing partners). By proceeding to payment you authorise HomeShift and its payment processors to charge your selected payment method for the agreed one-time fee (and, where applicable, any agreed success/referral fees at closing), and you confirm that you are the cardholder or have the cardholder’s authority to use the card.
- Agent-assisted payments. In some cases, you may choose to provide your card details to a HomeShift representative over the phone or during a live call so that the representative can complete the secure payment form on your behalf. By doing so, you (a) authorise our representative to enter your card details into our secure payment page and submit the payment; (b) confirm that you are the cardholder or have authority to use the card; (c) agree that the transaction will be processed as a card-not-present / remote transaction; and (d) acknowledge that HomeShift does not record or store your full card number or CVV/CVC in its own systems. You must not send card details by email, SMS, messaging app or social media.
- Chargebacks & disputes. If you have a question or dispute about a charge, you agree to contact HomeShift first so we can review and attempt to resolve it. If you open a chargeback or payment dispute with your bank or card issuer, we may provide copies of your agreement, call logs and other records to our payment processor and to your bank as evidence of your authorisation and our work performed.
- Liability. To the maximum extent permitted by law, HomeShift is not liable for indirect, consequential, incidental or punitive damages, loss of profit, loss of opportunity or loss arising from third-party actions or decisions. Our total liability in connection with any claim is limited to the amount of fees you paid to HomeShift for the specific service giving rise to that claim.
- Disputes & governing law. Any dispute arising out of or in connection with this agreement shall be resolved by binding arbitration or similar alternative dispute resolution, under recognised rules (for example ICC or a similar body), in a venue and under governing law reasonably connected to your residence or the location of the services, unless a different jurisdiction is required by applicable consumer law.
- Privacy & data protection. Personal data is handled in accordance with our Privacy Policy. We do not sell your personal data to unaffiliated third parties without your consent. Payment card details are processed by PCI-compliant third-party payment processors and are not stored by HomeShift in full or in a way that would allow them to be reused for unauthorised transactions.
